If within the lifetime of your concrete any of the above products which were provided by BioSeal Canada Inc. prove to be defective in material or workmanship or fail to produce results consistent with . specifications for the application in question BioSeal Canada Inc will replace any defective product or issue a full refund of the purchase price at BioSeal Canada Inc 's sole discretion. BioSeal Canada Inc . cannot be responsible for inferior materials and other products used previously providing an unsatisfactory surface to warrant product performance. BioSeal Canada Inc . will not be responsible for the cost of removal, installation or re-installation of any products or items supplied by third parties, where such removal installation or re-installation is required to repair any defective products. Furthermore, BioSeal Canada Inc . will not be responsible for and assumes no liability for the materials or workmanship or any transportation charges, labor costs or other related replacement of defective products, without BioSeal Canada Inc 's prior written consent. This warranty will be voided if (a) the products have not been stored, installed, or maintained or applied in accordance with accepted industrial practice. (b) The products have been subjected to any accident, misapplication, abuse or misuse, (c) Buyer has used, repaired, or modified the products after the discovery of the defect without BioSeal Canada Inc . prior written consent to continue use, (d) Buyer refuses to permit BioSeal Canada Inc . to determine the nature of defect claimed, (e) Buyer uses the product in an application inconsistent with BioSeal Canada Inc 's recommendations.

EXCEPT AS PROVIDED IN THIS WARRANTY, ALL WARRANTIES, UNDERTAKINGS, CONDITIONS OR REPRESENTATIONS (WHETHER INNOCENT OR NEGLECT) INCLUDING WITHOUT LIMITATION THOSE WITH RESPECT TO MERCHANTABILITY, FITNESS FOR ANY PARTICULAR PURPOSE QUALITY OR DURABILITY, WHETHER EXPRESSED, IMPLIED, STATUTORY ARISING FROM COURSE OF DEALING, USAGE OF THE TRADE OR OTHERWISE RESPECT TO ANY EQUIPMENT ORDER, ARE EXPRESSLY EXCLUDED. NO EXPRESSED OR IMPLIED WARRANTY IS GIVEN AS TO THE CAPACITY, EFFICIENCY OR PERFORMANCE OF ANY EQUIPMENT, EXCEPT AS MAY BE PROVIDED IN A WRITTEN AGREEMENT.
